A woman accused of orchestrating her sister’s murder and her alleged hitman were expected to make a formal bail application at the Camperdown Magistrate’s Court on Monday, but proceedings were delayed after legal representation issues emerged. Nikiwe Mngwengwe (34) and her co-accused, Duncan Phelelani Ntuli (33), known as Pe, face charges linked to the killing of Fundisa Mngwengwe, who was found dead at her home in Mkhambathini in March next to her three-year-old toddler. According to the charge sheet, the two face charges of conspiracy to commit murder and premeditated murder.
The state indicated it would oppose bail, citing concerns for the safety of witnesses, but was ready to proceed with bail. Proceedings took an unexpected turn when Mngwengwe, who had previously indicated she would appoint a private attorney, changed her stance upon entering the dock and applied for Legal Aid representation. Her application for Legal Aid was, however, declined after it was determined that she earns above the qualifying threshold.
Mngwengwe, who had a small blanket covering her face in the dock, then requested two days to secure a private attorney. The matter was postponed to Thursday to allow her time to obtain legal representation. She remains in custody at Westville Correctional Centre, while Ntuli is being held at New Prison in Pietermaritzburg.
