Questions are mounting over a murder charge previously brought against businessman Brown Mogotsi after it emerged that the case was withdrawn without explanation, prompting the uMkhonto weSizwe Party (MK Party) to call for full transparency from law enforcement authorities. The issue surfaced on Tuesday during proceedings of Parliament’s ad hoc committee probing allegations of criminality, political interference and corruption within the criminal justice system. These allegations were made by KwaZulu-Natal police commissioner Nhlanhla Mkhwanazi on July 6, 2025.

Party national spokesperson Nhlamulo Ndhlela warned that when serious charges are withdrawn without transparency, it creates a perception that some individuals may be shielded from accountability while ordinary citizens face the full might of the law. “This is not a matter for quiet internal processes. It is a matter of public trust.

The rule of law cannot function in the shadows,” said Ndhlela. The party has called on the South African Police Service (SAPS) and the National Prosecuting Authority (NPA) to urgently provide clarity on the reasons for the withdrawal. It is also seeking confirmation on whether any additional cases against Mogotsi were withdrawn and on what legal and evidentiary grounds those decisions were taken.

When pressed on the withdrawal, Mogotsi said he did not know the exact basis but claimed the state could not proceed because there were no witnesses, the only witness had since died. He confirmed he never entered a plea before the charge was dropped. Mogotsi was initially scheduled to appear before the committee last month but declined, citing safety concerns.
