The ANC has commended KwaZulu-Natal Legislature Speaker Nontembeko Boyce’s decision to decline the NFP national leadership’s request for the removal of the party’s sole MPL Mbali Shinga, who is also the MEC for Social Development. The NFP national executive committee (NEC), suspended Shinga’s membership accusing her of defying an instruction to support the MK Party’s recent motion of no confidence against Premier Thami Ntuli. The NFP wrote to Boyce, requesting that Shinga be removed as the party’s MPL.

Boyce, however, declined the request, explaining that removing Shinga as an MPL — for the reasons advanced by the NFP — would be a violation of the Constitution. ANC provincial spokesperson Fanle Sibisi said Boyce’s decision will go a long way in enhancing the KZN Legislature’s image. The ANC in KZN commends Boyce, for her unwavering stance in defending the integrity of the Legislature.

“The speaker’s latest principled stance follows another recent and commendable action in protecting the integrity of the Legislature. “She suspended members who acted improperly and were unruly during the sitting on December 15, 2025, which required police intervention to restore order. “Even in that challenging situation, she exhibited calm and composure in the face of overt provocation,” said Sibisi.

Boyce said that the constitutional requirements for Shinga’s removal have not been met. According to Boyce, in terms of Section 106(3) of the Constitution, MPLs can only be removed if they ceased to be members of the party that deployed them to the Legislature; were no longer eligible to be members of the Legislature; or, were absent from the Legislature without permission.
