The National Prosecuting Authority (NP) has withdrawn charges against Lieutenant-General Dumisani Khumalo, Brigadier Dineo Mokwele, Major-General Nozipho Madondo and their co-accused, following a directive from National Director of Public Prosecutions Advocate Andy Mothibi. The decision was taken before the accused entered pleas, with the NPA citing an ongoing investigation and the absence of a complete evidentiary record needed to proceed with the case. Mothibi has reportedly directed that the matter cannot be brought back without his written approval.

If the Investigating Directorate Against Corruption (IDAC) later recommends criminal proceedings, Khumalo and the other affected officials will be allowed to give their responses before further steps are considered. The withdrawal comes after a disputed arrest process involving Khumalo, which sparked complaints to the Ministers of Justice and Police. IDAC had confirmed that an arrest warrant had been issued, but the planned arrest did not take place. Khumalo and Madondo previously demanded answers from IDAC over the handling of the matter, including why their warning statements were not taken and why they were instructed to report to Brooklyn Police Station in Pretoria with clothing prepared for possible detention.
